Accident Report Privilege

Did you know if you’re in volved in an auto accident in Florida what you tell the police officer is a privileged communication? Just like other privileges under Florida law anything you say to the investigating officer cannot be used against you in a subsequent legal proceeding. The rationale for this privilege is to allow for the free flow of information. It is hoped this free flow of information will provide the proper authorities with information to prevent future accidents. Recently the courts have interpreted this privilege to only apply to those involved in the accident, not all witnesses. A Florida case was recently reversed by the appellate court when the statements of friends of the victim
